1 Who we are
These Terms and Conditions of Use ("Terms") apply between you and FamilyRun Ltd, a company registered in England and Wales under company number 17312091, whose registered office is at Lytchett House 13 Freeland Park, Wareham Road, Poole, Dorset, United Kingdom, BH16 6FA ("FamilyRun", "we", "us", "our").
These Terms govern your access to and use of the FamilyRun mobile application and associated website (together, the "Service"). By creating an account, joining a household, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.
2 The service
FamilyRun is a household management application that helps families organise a shared calendar and events, tasks, shopping and other lists, meal planning, school schedules, birthdays, and household notes, in one place.
Some features - for example recurring event and task management, multiple lists and list templates, and Family Mode (shared-device mode) - are available only to households with a FamilyRun Plus subscription, and are marked as such within the app.
3 Your account and household
- To use most of the Service you must create an account and either create a new household or join an existing one using an invite code.
- You must provide accurate information when registering and keep your login credentials confidential. You are responsible for all activity that occurs under your account.
- A household administrator ("Admin") may add other people to a household by inviting them to create their own account ("invited members"), or by creating a managed member profile for a child or other family member who will not have their own login credentials ("managed members"). See section 14, Children and Managed Members.
- You are responsible for the accuracy of information you and your household members enter into the Service.
4 Subscriptions (FamilyRun Plus)
FamilyRun offers a free tier and an optional paid subscription, FamilyRun Plus, which unlocks additional features. Subscriptions are purchased through the applicable app store - the Apple App Store or Google Play - or, where offered, through the FamilyRun website. Payment is handled by the app store or our payment processor, not directly by FamilyRun, and is subject to that platform's own billing terms.
We use RevenueCat to manage and synchronise your subscription status across devices and platforms. RevenueCat does not process your payment card details.
You may cancel a subscription at any time through your app store account settings. Cancelling does not delete your account data - your household simply reverts to the free tier at the end of the current billing period. Refunds are handled in accordance with the policies of the app store or payment processor through which you subscribed.
5 Acceptable use
You agree not to use the Service to:
- Upload or share content that is unlawful, abusive, harassing, defamatory, or infringes the rights of any third party
- Attempt to gain unauthorised access to any account, household, or part of the Service that is not your own
- Introduce viruses, malware, or other harmful code, or attempt to disrupt or overload the Service
- Use automated means (bots, scrapers) to access the Service other than through the app itself
- Misuse the invite code or household-joining system to access a household you have not been invited to join
We may suspend or terminate your access if we reasonably believe you have breached this section.
6 Household data and content
You retain ownership of the content you and your household create in the Service - events, tasks, lists, notes, school information, and similar ("Household Content"). You grant FamilyRun a limited licence to store, process, transmit, and display that content solely to provide the Service to you and members of your household.
We apply reasonable technical measures - including database-level access controls - to ensure Household Content is only accessible to members of the household it belongs to.
You are responsible for the accuracy and lawfulness of Household Content and for obtaining any necessary consent before adding information about another person - including a child - to the Service.
7 Availability of the service
We will use reasonable skill and care to keep the Service available and operating correctly. The Service depends on third-party infrastructure - including hosting, authentication, push notification, and email delivery providers - that sits outside our direct control, so we cannot guarantee the Service will always be available, uninterrupted, secure, or error-free.
8 Bugs, errors and notifications
FamilyRun is software and may contain bugs or errors from time to time. We use reasonable efforts to identify and resolve issues but cannot promise the Service will always function exactly as intended.
Push notifications, reminders, and digest emails are provided as a convenience. Delivery depends on factors outside our control - your device's operating system, notification permissions, network connectivity, and third-party push and email infrastructure. We do not guarantee that any notification will be delivered or delivered on time. Please do not rely on notifications as your sole method of tracking time-critical commitments - check the app directly for anything important.
Where reasonably possible, we will give advance notice of planned maintenance likely to materially affect availability of the Service.
9 Service changes and discontinuation
We may change, add to, remove, or discontinue features of the Service at any time, including in response to technical, legal, or commercial requirements.
If we decide to discontinue the Service entirely, we will - where reasonably possible - give at least 30 days advance notice within the app or by email, and make reasonable efforts to let you export your Household Content before the Service closes.
10 Intellectual property
Except for Household Content, all intellectual property rights in the Service - including the FamilyRun name, logo, app design, and underlying software - belong to FamilyRun Ltd or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own household's personal, non-commercial use, in accordance with these Terms.
11 Third-party services
The Service relies on third-party infrastructure to operate, including cloud hosting and database services, authentication services, and email delivery services. Details of these providers and their role in processing your data are set out in our Privacy Policy. We are not responsible for outages or errors that originate solely within a third-party provider's own systems.
12 Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded under English law.
Subject to the above, FamilyRun is only liable to you for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable skill and care. In particular:
- We are not liable for any loss or damage that was not foreseeable
- We are not liable for indirect or consequential loss, including financial loss arising from a missed appointment, reminder, or event
- We are not liable for loss or damage arising from content, actions, or omissions of you, other members of your household, or third parties
- Our total liability will not exceed the greater of £50 or the total subscription fees you paid in the 12 months before the event giving rise to the claim
Nothing in this section affects your statutory rights as a consumer, including under the Consumer Rights Act 2015.
13 Indemnification
You agree to indemnify FamilyRun against reasonable losses, damages, and costs (including legal fees) arising from your breach of these Terms or your misuse of the Service, except to the extent caused by our own breach or negligence.
14 Children and managed members
Managed member profiles let an Admin represent a child or other family member who does not hold their own FamilyRun account, storing only a first name, role, and optionally year group and school-related information needed for School Mode.
By creating a managed member profile, you confirm you are the parent, legal guardian, or otherwise hold appropriate authority to add that person's information to the Service, and that you consent on their behalf to the processing described in our Privacy Policy.
We do not knowingly collect login credentials, contact details, or account information directly from children.
15 Termination
You may stop using the Service or delete your account at any time via the in-app Delete Account flow. We may suspend or terminate your access if you materially breach these Terms, or where reasonably necessary to protect the security or integrity of the Service or other users.
Sections 6, 10, 12, 13, 17, and this section survive termination of these Terms.
16 Complaints and dispute resolution
If you have a complaint about the Service, please contact us first at support@familyrun.co.uk so we can try to resolve it directly. We aim to acknowledge complaints within 5 working days before any dispute is escalated further.
17 Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. If you are a consumer, you may bring proceedings in the courts of the part of the UK in which you live, or in the courts of England and Wales. We will bring proceedings against you only in the courts of the jurisdiction in which you live.
18 Changes to these terms
We may update these Terms from time to time - for example to reflect changes to the Service or to applicable law. We will notify you of material changes within the app or by email before they take effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
19 General
- If any provision of these Terms is found unenforceable, the remaining provisions continue in effect.
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and FamilyRun regarding the Service.
- Our failure to enforce any right under these Terms is not a waiver of that right.
